Granted on September 26, 2013 by Judge David O Carter of the United States District Court for the Central District of California, the injunction prohibits the defendants from
(1) marketing, selling, or otherwise offering for sale any product created or manufactured using, relying on, or otherwise benefitting from Meggitt’s trade secret, confidential, and/or proprietary information, in particular Niell-Tech’s Model No CAYD051V, CAYD053-50, and CAYD063V products; and
(2) using any source code or software developed by Meggitt or derived from software developed by Meggitt.
The injunction also requires the defendants Niell Electronics and Mr Nie to return any and all records or documents reflecting Meggitt’s trade secret, confidential, and/or proprietary information.
Judge Carter granted the preliminary injunction after finding that Meggitt had demonstrated a likelihood of success with its claim for trade secret misappropriation against Niell Electronics and Mr Nie in Case No SACV 13-239-DOC (MLGx), styled Meggitt (San Juan Capistrano), Inc. v.
